What Do I Have to Prove to Win a Personal Injury Case?

Most personal injury cases in Missouri are based on negligence. Negligence means that another person had a duty to act reasonably but failed to do so, and caused you to suffer injuries in the process.

In order to win a negligence claim, you’ll have to establish each of the following elements:

  • Duty: The defendant owed you a duty of care
  • Breach: The defendant breached that duty of care, meaning that they failed to act reasonably under the circumstances
  • Causation: The defendant’s conduct was a direct and proximate cause of your harm.
  • Injury: You sustained an injury or damages of some sort

Note, not all injury claims are based on negligence. There are times when defendants might be strictly liable for the harm you experience. This is most often the situation in cases involving dog bites and defective products. With strict liability, there’s no need to prove someone was careless. Rather, they’re liable because the law says so.

What Compensation Can I Get If I’m Injured in an Accident?

If you’re injured due to someone else’s negligence, you’ll probably be able to secure compensatory damages from the responsible party. Compensatory damages fall into one of two categories: economic and non-economic.

Economic damages are awarded to make you financially whole after your accident. By recovering economic damages, it shoudl be as if the accident never happened at all – at least in terms of money. Can I Still Get Money If I’m Blamed For an Accident?

Yes – as long as someone else is responsible, too. Missouri has pure comparative negligence rules. Everyone who contributes to an accident shares blame – including those who get hurt.

If you share responsibility for an accident, it doesn’t mean you cannot recover compensation. It simply means that your financial award will be reduced. If you’re 30% to blame, your damages will be reduced by 30%. And, you’ll be 30% responsible for damages sustained by others in that same accident.

How Long Do I Have to File a Lawsuit in Missouri?

Five years is the standard statute of limitations that applies to personal injury lawsuits in the state of Missouri

However, there are times when a different time limit will apply. Wrongful death cases are subject to a three-year time limit, workers’ compensation claims have to be brought within two years of a workplace injury, and claims involving the government must be filed within 90 days of injury.

If you miss the deadline that applies to your case you’ll lose the right to recover compensation for your injuries.
