Can I Get Money If I’m Blamed For an Accident?

Yes, as long as someone else shares some of the blame, too. Missouri has what’s known as “pure comparative negligence” rules.

This means that anyone who contributes to an accident shares liability for resulting harm. Sharing blame doesn’t mean that you can’t recover compensation, but it does mean that your financial award will be affected.

How Long Do I Have to File a Lawsuit?

In Missouri, you’ll typically have five years to file a lawsuit after you get hurt in an accident. There are, however, times when a different statute of limitations might apply.

Wrongful death lawsuits are subject to a three-year time limit. If you’ve been injured and want to recover compensation from the city of St. Louis, you’ll have just 90 days to file a formal claim.
